Allgemeine Geschäftsbedingungen
Stand: 03.10.2026
§ 1 Geltungsbereich
(1) Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge über Fotoshootings zwischen Elena Malseva (Elena Witch Photography) (nachfolgend „Fotografin"), und Verbraucherinnen und Verbrauchern (nachfolgend „Kundin"; gemeint sind Personen jeden Geschlechts).
(2) Abweichende Bedingungen der Kundin gelten nicht. Individuelle Vereinbarungen im Angebot haben Vorrang vor diesen AGB.
§ 2 Vertragsschluss
Terms and conditions
This translation is provided for convenience. Only the German version above is legally binding.
As of: 03.10.2026
§ 1 Scope
(1) These general terms and conditions apply to all contracts for photo shoots between Elena Maltseva (Elena Witch Photography) (the "photographer"), and consumers (the "client").
(2) Deviating terms of the client do not apply. Individual agreements in the offer take precedence over these terms.
§ 2 Formation of the contract
(1) The presentation of services on the website is not a binding offer. A booking request through the form is not binding on either side.
(2) In reply to a request, the photographer sends an offer by e-mail with the date, time, location, scope of services and price, and a personal link. The offer is valid for [7] days.
(3) The contract is concluded when the client accepts the offer on the linked page by confirming these terms and clicking the button „Zahlungspflichtig buchen" ("Book with obligation to pay"). The client then receives a confirmation by e-mail with the contract details, these terms and the withdrawal notice.
(4) The language of the contract is German. The photographer stores the contract text; the client can access it through the personal link and in the confirmation e-mail.
§ 3 Services
(1) The scope, duration and location of the shoot follow from the accepted offer.
(2) The photographer selects the best shots and edits them (colour, exposure, contrast, cropping). The number of photos delivered follows from the offer. Extensive retouching is only included by separate agreement. There is no claim to unedited images (raw files).
(3) The image composition (perspective, light, editing style) is at the photographer's artistic discretion. Sample images serve as orientation.
§ 4 Prices and payment
(1) The prices in the accepted offer apply. [Pursuant to § 19 UStG, no VAT is charged.]
(2) The fee is due after the shoot and payable within [14] days of receiving the invoice — in cash, by card, via PayPal or by bank transfer.
(3) If a studio is booked, the studio costs are external costs payable in advance. The photographer sends the payment details after the contract is concluded.
§ 5 Delivery of the photos
(1) The edited photos are made available in an online gallery within [3] weeks of the shoot; the photographer informs the client by e-mail.
(2) The gallery is available for download for [60] days. The client is responsible for backing up the photos; the photographer does not owe permanent archiving.
§ 6 Usage rights
(1) The copyright in the photos remains with the photographer.
(2) Upon full payment, the client receives a simple, non-transferable licence, unlimited in time, for private purposes. This includes prints, photo books and posting on private social media profiles. When posting online, a credit "Photo: Elena Witch" is requested.
(3) Commercial use (e.g. advertising, a company website) requires a separate agreement.
§ 7 Rescheduling and cancellation by the client
(1) The appointment can be rescheduled once free of charge up to [7] days before.
(2) If the client cancels the appointment, the photographer may claim flat-rate compensation:
- up to [14] days before the appointment: none,
- up to [3] days before the appointment: [25] % of the agreed fee,
- after that or if the client does not show up: [50] % of the agreed fee.
(3) The client remains entitled to prove that the photographer suffered no loss or a substantially lower loss.
(4) Studio costs already paid are refunded to the extent the studio refunds them; otherwise they are borne by the client.
(5) The statutory right of withdrawal (see the withdrawal notice) remains unaffected.
§ 8 Cancellation by the photographer, weather
(1) If the photographer cannot keep the appointment for reasons beyond her control (e.g. illness, force majeure), a new date is agreed. If no new date is possible, amounts already paid are refunded in full. No further claims exist in this case.
(2) If an outdoor shoot cannot reasonably take place because of the weather, either side may request free rescheduling.
§ 9 Liability
(1) The photographer is liable without limitation for intent and gross negligence and for injury to life, body or health.
(2) For slight negligence, the photographer is only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes performance of the contract possible in the first place and on whose observance the client may regularly rely), limited to the foreseeable damage typical for the contract.
(3) Liability under the Product Liability Act (Produkthaftungsgesetz) remains unaffected.
§ 10 Publication of photos by the photographer
The photographer publishes photos showing the client only with the client's separate, voluntary consent. The booking does not depend on this consent.
§ 11 Data protection
Information on the processing of personal data is given in the privacy policy on the website.
§ 12 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in the withdrawal notice.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which the client has her habitual residence remain unaffected.
(2) If a provision of these terms is invalid, the rest of the contract remains valid; the statutory provisions take the place of the invalid provision.
